The IEEPA tariff refund refers to potential refunds on tariffs applied under the International Emergency Economic Powers Act (IEEPA), following recent legal developments. Eligible importers may be able to recover duties paid on certain entries.
An importer of record or their authorized licensed customs broker can initiate a refund claim by filing a CAPE Declaration in the ACE Portal. Entries are generally eligible for CAPE Phase 1 automated processing if they are unliquidated (not finalized) or if they were liquidated within the last 80 days. However, some of these entries are excluded by CBP rules. Examples of these exclusions are entries with reconciliation flags or Entry Type 09 (Reconciliation Summary), entries covered by an active protest or tied to a drawback claim, non- ACE entries and certain AD/CVD entries.
